General Issues
Ownership of all wines sold passes from WineBank to the buyer in Menlo Park, California. Buyer will hold WineBank harmless for any damage that may occur in the delivery of wines sold. These possible damages may include, but are not limited to, spoilage due to extremes of temperatures, breakage and excessive vibration.

Buyer certifies that he/she is at least 21 years of age. Buyer will have to certify to this on our secure server prior to placing an order. Further certification may be required at time of delivery. All sales are final unless there is an error in listing or other erroneous information provided by WineBank.

Refund Policy

All sales are final unless there is an error in listing or other erroneous information provided by WineBank. We inspect all wines and take the utmost care in the handling and proper storage. Unless otherwise noted, all bottles on the site can be assumed to be in very good to excellent condition. We will provide information concerning the physical appearance of any bottle that is not normal for its age. We strive to ensure that all wine is of sound condition and is shipped in such a way that this condition is maintained. However, we are unable to accept responsibility for the state or condition of these wines, nor are we able to guarantee that the wine in the bottle corresponds to the quality or attributes which might be expected from its description. Older bottles from the same case may have significant bottle variation.
We will make no representation about the actual suitability of the wine for consumption. All wine is sold “AS-IS,” without any representations or warranties, express or implied, including, but not limited to, “drinkability” or possible spoilage due to the wine’s advanced age or poor storage prior to our receiving them or the correctness of the website or other description of physical condition. “Old” wines are especially NOT guaranteed for drinkability or against spoilage. As we are not responsible for any damage during shipping, the buyer should be aware of the weather their shipment is likely to be subject to before requesting shipment of their wine. We will arrange for insurance on all the shipments on behalf and at the expense of the buyer. Insurance does not cover any loss or damage due to exposure to temperature variations, shipping delays, or defect in or failure of any cork or other bottle closure. If your shipment is delayed or arrives broken, contact WineBank not the carrier. In the event of loss or breakage, WineBank will handle all claims. Do not contact the carrier directly. Wines spoiled by changes in temperature cannot be recovered. Please choose your shipping address carefully. We cannot replace wine damaged by heat or cold exposure.
These Terms and Conditions of Sale, as well as the rights and obligations of both buyer and seller hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of California. You consent to this exclusive jurisdiction with regard to any wine purchased from us. We shall not be liable for any failure to meet our obligations by circumstances beyond our control. In no event shall our liability ever exceed the purchase price actually paid for such wine.

Shipping

WineBank will attempt to offer shipping of wine to addresses where shipping is legal. WineBank will reserve the right not to ship to any address that WineBank believes may subject WineBank to possible legal consequences. Our shipping prices will include the cost of packing materials, insurance and handling.

Shipping VS Weather
Being subjected to extremes of temperatures during prolonged shipping can spoil wine. This is especially true during the summer and winter months. Shipping cross-country during these seasons is strongly discouraged. WineBank will be glad to store your purchases free of charge until next safe shipping season. If delivery during these seasons is still desired, overnight shipping is recommended. We will attempt to ship wines early enough in the week to lessen the possibility that wines will spend the weekend in transit.
